Terms & Conditions - The ground rules for working with Wolf Creek Digital

1. General Usage & Acceptable Use

• Lawful Purposes Only: Wolf Creek Digital services may only be used for lawful purposes. Transmission, storage, or presentation of any information, data, or material in violation of any U.S. Federal, State, or local regulation or law is strictly prohibited. This includes material protected by copyright, trade secret, or other statutes, as well as threatening or obscene material.
• Prohibited Content: We do not endorse or host materials that may be offensive, inflammatory, or of an adult nature (pornography). Wolf Creek Digital disclaims any and all liability for such content and reserves the right to remove such materials at our sole discretion.
• Termination for Cause: We reserve the right to terminate any account that does not abide by our Terms of Service or Acceptable Use Policy immediately and without prior notice.

2. Billing and Payments

• Accuracy of Information: You agree to provide Wolf Creek Digital with accurate and complete contact and billing information. It is your responsibility to contact us regarding any changes to your account, such as phone number, address, or billing details.
• Fraud: Wolf Creek Digital will not tolerate payment of accounts or services by fraudulent means. Doing so will result in immediate termination and potential criminal or civil liabilities.
• Delinquency: Accounts will be considered delinquent if payment is not received within 30 days of the due date.
  • Suspension/Termination: Delinquent accounts may be suspended, archived, or terminated from our system.
  • Data Loss: We are not responsible for any loss of data on delinquent accounts.
  • Reconnection Fee: We reserve the right to charge a service reconnection fee for any delinquent, suspended, or reactivated account.

3. Refund Policy & No Returns

Due to the custom nature of digital marketing, web design, and creative services, Wolf Creek Digital maintains a strict No Return / No Refund policy.

• Services Are Non-Refundable: All services (including but not limited to SEO, consulting, design, development, and content creation) are intangible and involve the expenditure of time and labor that cannot be returned. Once fees are paid and/or work has commenced, all sales are final.
• No Change of Mind Refunds: We do not offer refunds if you change your mind, decide to cancel a project mid-stream, or find a different provider.
• Acceptance of Deliverables: By approving a draft, design mock-up, or the final launch of a website/campaign, you agree that the work has been completed to your satisfaction. Once a deliverable is approved or a website is launched, it is considered accepted and cannot be returned for a refund.
• Hosting & Recurring Fees: Hosting payments and monthly retainer fees are non-refundable. If you cancel your service, you will not be billed for future months, but no pro-rated refunds will be issued for the remaining days in the current billing cycle.

4. Email and Anti-Spam Policy

• Zero Tolerance for Spam: You may not send unsolicited or spam email to any account that has not specifically requested information.
• Prohibited Transmissions: Transmission of email that is harassing, libelous, defamatory, legally obscene, threatening, abusive, or hateful to non-consenting recipients is prohibited.
• Chain Letters: Forwarding of chain letters of any type (including charity requests or petitions) is prohibited.
• Termination: Violation of these email policies will result in immediate termination of services.

5. Intellectual Property

• Client Ownership: Upon full payment of all invoices, the Client shall own the final specific visual designs and content created specifically for the Client.
• Company Rights: Wolf Creek Digital retains all rights to our underlying code, libraries, frameworks, and tools used to create your project. We grant you a perpetual, non-exclusive license to use these tools for the operation of your website.
• Copyright Infringement: Wolf Creek Digital reserves the right to remove any materials that infringe on copyright work or violate U.S. laws.

6. Limitation of Liability & Indemnification

• Service "As Is": Services are provided on an "as is" and "as available" basis. Wolf Creek Digital makes no warranties, expressed or implied, regarding the reliability or uptime of hosting services or third-party tools.
• Limitation: In no event shall Wolf Creek Digital be liable for any direct, indirect, incidental, special, or consequential damages (including loss of data or profit) arising out of the use or inability to use our services.
• Indemnification: Customer agrees to defend, indemnify, and hold harmless Wolf Creek Digital from any claims, liabilities, losses, costs, and claims, including reasonable attorney's fees, asserted against us that may arise or result from any service provided or performed or agreed to be performed or any product sold by Customer, its agents, employees, or assigns.
